Private release from work to be worked off
As of 23 August 2013 the amendment to the Labour Code, which regulates the so-called private release from work (art.151 § 21 inserted by art. 1 point 5 of the Act of 12 July 2013, Dz.U.2013.896), entered into force. This amendment introduces a solution to work off (by the employee), granted to him upon his written request, release from work to attend to personal matters. Under the new rules this work off will not constitute an overtime work, provided that the executed release from work does not affect the right of an employee to daily and weekly rest period.
New regulation does not provide directly any limits in terms to work off the time nor terms to grant a permition from an employer (what is worth to notice for the proof reasons). It seems rational, e.g. for the calculation of the remuneration reason, that the work off takes place directly after the release (in the same or nearest days).This work may not however affect the right of an employee to daily and weekly rest period.
It is a positive change. So far law provisions did not provide for such regulation. This regulation eliminates doubts regarding the calculation of releases granted to employees in the light of overdue working hours. Due to the fact that in order to receive the full remuneration agreed the employees are strongly interested to work off the free time granted to them, the new rules seems like practical and useful solution.
